Closet Club Terms and Conditions

Welcome to Closet Club! These terms and conditions (the "Terms") govern your use of the Closet Club platform and services (the "Service"). By using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.Definitions"Closet Club," "we," "us," or "our" refers to the company providing the Service."User," "you," or "your" refers to any person or entity using the Service."The Item(s)" refers to any items (apparel, shoes, handbags, and accessories) posted on the site that are available to be borrowed or purchased."Lender" refers to any user who posts an item available to be borrowed."Renter" refers to any user who borrows an item."Buyer" refers to any user who purchases an item."Seller" refers to any user who sells an item.Rental TermsRenters may rent items for a period of up to 7 days.Renters may extend the rental period with the consent of the Lender, and payment for the extended rental period will be charged accordingly.Renters must return the item(s) by the agreed-upon date.If a Renter returns an item late, they will be charged a late fee of $5 per day for every day past the agreed-upon date.Renters are responsible for any damage or loss of the item(s) while in their possession and will be charged accordingly.Selling TermsSellers may post items for sale on the platform.Sellers are responsible for the accuracy of the item(s) description and images.Buyers may purchase items for the listed price or make an offer to the Seller.Buyers must pay for the item(s) within 24 hours of purchase or the sale may be canceled.Closet Club charges a service fee of 16% of the final sale price for all items sold on the platform.Payments and RefundsPayments will take place through our business Venmo account, which is @Closetclub.Renters or Buyers will be requested two separate Venmo payments (if applicable) upon pick-up of the item.If the Renter or Buyer chooses to use the try-on service for the item they requested to rent or buy, they will receive two Venmo requests, one for the try-on fee (plus 3.5% service charge) and one for the rental or resale price of the item.
The request for the try-on is to be completed within the hour of pick-up.The same goes for the item Venmo request, unless they determine and communicate to the Support Team that they were unsatisfied with the item within the hour, in which case they may decline that secondary Venmo request.If the Buyer/Renter bought the try-on service and is unsatisfied with their item, they are expected to return the item to our support team at a specified date.The seller and lender will be Venmoed from our Closet Club business account the resale or rental price of the item less the 14% service fee within 24 hours, assuming that the renter/buyer is satisfied with their purchase within the try-on period, assuming they purchased that service.Disclaimer of WarrantiesThe Closet Club platform and services are provided on an "as is" and "as available" basis. We do not represent or warrant that the use of our platform and services will be secure, timely, uninterrupted or error-free or that the platform and services will meet your requirements or expectations. We also make no representations or warranties as to the quality, suitability, reliability, timeliness, accuracy or completeness of the content available on our platform and services.Limitation of LiabilityIn no event shall Closet Club or its affiliates, directors, officers, agents, contractors, partners, or employees be liable for any direct, indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the platform and services; (ii) any conduct or content of any third party on the platform and services, including without limitation, any defamatory, offensive or illegal conduct of other users or third parties; (iii) any content obtained from the platform and services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.Late FeeRenters will be charged a late fee of $5 per day for every day that they return the item past the agreed-upon date.TerminationWe may terminate or suspend access to our platform and services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the terms. Upon termination, your right to use the platform and services will immediately cease.Entire AgreementThese Terms and Conditions constitute the entire agreement between you and Closet Club with respect to the use of the Platform and supersede all prior or contemporaneous communications and proposals (whether oral, written or electronic) between you and Closet Club with respect to the Platform.SeverabilityIf any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms and Conditions will otherwise remain in full force and effect and enforceable.AssignmentCloset Club may assign these Terms and Conditions, in whole or in part, at any time without notice to you. How does the exchange process work?

~Closet Club contacts both parties when an item is requested. Closet Club offers direct drop off and pick up on the requested dates for a fee. For no charge, the parties can coordinate a pick up and drop time with the Closet Club team. ~

What if the item doesn't fit or I don't like it?

_{The lender or buyer must request the 1-hour try period for a small fee prior to the exchange. The lender or buyer will get a full refund and the exchange will be cancelled. The lender or buyer is fully responsible to pay for the agreed exchange price if no try on period is requested.}

Am I supposed to wash/dry clean the item I borrow before returning to the lender?

_{The lender sets the preference for the condition the item must be returned in. The borrower will be notified and must agree to the lender's terms before the exchange. Closet Club will provide dry cleaning for an additional fee if requested from the lender.}

When/how do I get paid as a lender/seller?

~Closet Club will Venmo the lender or seller once the payment has been received by Closet Club from the borrower or buyer. The borrower or buyer must Venmo Closet Club for the exchange to be completed. ~When/how do I pay for the item I am renting/buying?

_{Closet Club will Venmo request the buyer or renter upon submission of the request for the try-on charges (if applicable). You are expected to accept that request prior to receiving the item. You will receive a secondary Venmo request for the price of the listing upon obtaining item.}

What if the item accidentally gets stained or damaged?
_{For an item that is damaged beyond wear, the original price of the item must be fully compensated back to the lender. See our Terms & Conditions for more information.}

What if the borrower returns the item late?

_{The borrower will be charged a late fee of $5 for each day the item is returned late. If the item is not returned within ten days, the borrower will have to pay 100% of original value of the item to the lender.}

How long are the rentals for?

_{A standard rental length is 4 days unless stated on the listing. Borrowers can request a longer rental period under certain circumstances but will be subject to an additional $2 charge per day.}

Can an item request be cancelled?

~Email CC Support to make a cancellation. A cancellation must be sent 24 hours before the start of the requested date. ~

How does a lender or seller get alerted of requests?
